What H&C applications are (overview)

• Humanitarian & Compassionate (H&C) applications ask Immigration, Refugees and Citizenship Canada (IRCC) to consider a person’s individual hardship or compassionate circumstances as grounds for permanent residence when no other standard program applies.
• Typical H&C factors can include:

- best interests of children

- family separation and hardship

- ties to Canada

- establishment and community integration

- any circumstances that would make removal particularly harsh or unjust

• H&C is a discretionary process: IRCC weighs all evidence and decides whether to allow a permanent residence grant on humanitarian and compassionate grounds.

How we handle H&C files (what to expect)

We take a stepwise, evidence-first approach to H&C files.

1) Intake and free assessment

• During the assessment we ask about your immigration history, family ties, length of time in Canada, and the specific factors that may support an H&C claim.

2) Strategic case plan

If an H&C request is appropriate, we prepare a case plan that identifies:

• the strongest compassionate and hardship factors
• the documents needed to support them
• any supplementary steps that may help support the file (for example: medical reports, psychological assessments, affidavits from family/community, and school/employer letters)

3) Evidence collection and drafting

• We draft the legal submissions and the principal hardship letter(s) that set out the narrative and legal arguments for the H&C request.
• We coordinate collection of supporting documents, witness affidavits, and expert reports when needed.

4) Submission and follow-up

• We file the H&C application or submission package with IRCC and monitor the file.
• We prepare our client for possible requests for further information and for interviews if required.

5) Post-decision options

If IRCC refuses an H&C application, we review the decision and advise on any available review or appeal options that may apply.

• Document-driven intake: A complete file depends on strong supporting evidence, which may include affidavits, medical or psychological reports (when relevant), employer/school/community letters, and other documentary proof of hardship and ties.
